MTN Upstream Promo Competition

1. Campaign :
** Upstream Promo 2017 (the “Promotion “). This Promotion is organised by Mobile Telephone Networks (Proprietary) Limited (“MTN”) and Upstream Systems South Africa (“Upstream”) together referred to as the (“Promoter/s”).

** The Promotion provides customers the opportunity to subscribe to content services in terms of which customers can win prizes as detailed in these Terms and Conditions.

Campaign Period

** The Promotion commences at 00:00 on 7 February 2017 and will continue until 23:59 on 5 June 2017 (the “Promotion Period”).

Who May Enter

3.1 To be eligible to participate, the entrant must :
3.1.1 be any MTN subscriber (PayAsYouGo, TopUp or Contract);
3.1.2 be a natural person;
3.1.3 where the prize concerned is a vehicle, be in possession of a valid South African driver’s licence; and
3.1.4 be 18 (eighteen) years old or older.

3.2 Participation in this Promotion excludes employees, directors, members, partners, consultants and agents of, or any other person who, directly or indirectly controls or is controlled by the Promoter/s or marketing service providers of this Promotion, (and the spouses, life partners, immediate family members or business partners of the people or entities listed above).

This means :
3.2.1 the Promoter/s;
3.2.2 supplier/s of goods and or services in terms of this Promotion; and
3.2.3 promotional partners, printers, advertising and promotional agencies, professional advisors and point of sale staff employed by or contracted to, or providing goods or services of any kind, to all the people or entities listed above during the Promotion Period.

How to Enter

4.1 During the Promotion Period, the entrants that meet all of the criteria referred to in clause 3 above must do the following in order to participate :

4.1.1.1 Customers must subscribe to one of the three interactive services (“Content Services”) listed below :
4.1.1.1.1 SMS based fitness tips with a link to the full article mobisite version;
4.1.1.1.2 SMS based proverbs with a link to the full article mobisite version; or
4.1.1.1.3 SMS based French lessons with a link to the full article mobisite version.
4.1.1.2 Customers accept that their mobile number will be shared with the promotional partner upon subscribing to services upon accessing the mobisites.

4.1.1.3 In order to subscribe the user must send a free of charge SMS to the below listed numbers to subscribe to any one of the services

4.1.1.4 The customer will be liable for the following costs for subscription to the services:

4.2 Once the qualifying entrant has fulfilled the requirements of clauses 3 and 4.1 above, he or she will be automatically entered into the lucky draw as follows :
4.2.1.1 For a participant to win the Content Services prize they must successfully subscribe to any Content Service to enter the respective draw.

4.2.1.2 During the Promotional Period Participants earn 1 point per Premium Service upon subscription to any Premium Service. Thus the maximum number of points that can be accumulated is 3, consisting of one point per each Premium Service.

4.2.1.3 Participants do not need to be active (remain a subscriber to the Content Services) on the day of the draw to enter the draw.
4.2.1.4 Users participate in each Content Draw with the point obtained upon subscription to that service only i.e. no point accumulation from other Content service(s).

4.2.1.5 Each point the participant earns equates to one draw entry to win the following prizes for each of the services respectively :

4.3 Please note: entry by intelligent devices (e.g. modems, telemetry devices and the like) or machines shall not be permitted for entry and will not be eligible for Prizes.

4.4 The lucky draws shall take place on 8 June 2017 or as soon as possible thereafter.
4.5 Winners will be notified telephonically by the Promoter/s and/or its authorized agents on or as soon as possible after each of the draws respectively.

4.6 Entrant’s acknowledge and accept that the Promoter/s shall utilize a third party (the Promoters’ authorized agent/s) to contact the entrant, in the event that the entrant is a winner, and arrange delivery of the Prize. In order to effect the contacting and delivery process, the Promoters shall provide the entrant’s information to such third party.

4.7 Customers may opt out of the services by SMSing STOP to :

4.8 On opting out, the service will be cancelled immediately

The Prize

5.1 Entrants that fulfil the requirements stated in clause 3 and 4 above, stand a chance to win :
5.1.1 1 (one) of the 3 (three) prizes stated in clause 4 for the Content Services, according to the service they are subscribed to. (Collectively, referred to as the “Prize”).
5.2 Prizes shall be delivered to the winner 60 (sixty) days after the end of the Promotion Period at a time and place to be agreed upon between the Promoter/s and the winner.
